Federal High Court Halts Governor Yusuf from Further Demolitions in Kano

A Federal High Court, led by Justice S.A. Amobeda, convened in Kano on Friday and issued an Ex-Parte Motion that effectively halts the state Governor, Engr. Abba Kabir Yusuf, from carrying out any additional demolitions of structures and properties within the state.
The Ex-Parte Motion was filed by Saminu Muhammad, a citizen, through his legal representative.
The court order specifically restrains the Kano State Government and its agents from demolishing certain buildings located along BUK Road. Justice S. A. Amobeda specifically directed the Kano state government to cease plans to demolish the applicant’s properties situated at No. 41 and 43 Salanta, along BUK Road, Kano.
The respondents named in the lawsuit include the Attorney-General of Kano State, Solicitor General of Kano State, Governor of Kano State, Kano State government, Kano State Bureau for Land Management, Kano State Urban Planning and Development Authority, Inspector-General of Police, Nigeria Police Force, Commissioner of Police, Commandant General of Nigeria Security and Civil Defence Corps, and Nigeria Security and Civil Defence Corps.
Following the presentation of the motion by the applicant’s counsel, Prof. Nasiru Aliyu, SAN, the court ordered an expedited hearing of the case and adjourned the proceedings until July 10, 2023.
The relevant portion of the court order states: “This Court hereby issues an interim order restraining the Respondents, by themselves, agents, servants, or proxies, from encroaching, trespassing, entering, invading, demolishing, revoking the Applicant’s titles, or undertaking any other acts concerning the Applicant’s properties at No. 41 and 43 Salanta, along BUK Road, Kano, covered by Certificate of Occupancy No. KNMLO8228 and Certificate of Occupancy No. KNMLO8229, pending the hearing and determination of the Originating Motion.
Additionally, this Honourable Court grants permission for the court’s bailiff to serve the third party.” it added.
